Not All Florida Mediators are Created Equally
If a mediation is going to have a chance at success, one of the most important
decisions is who will sit in the neutral chair at the head of the table.
As a certified mediator, Attorney Ron Darrigo belongs to an invitation-only
chapter of The National Academy of Distinguished Neutrals that recognizes
professionals that have met formal eligibility criteria that include mediator
certification, two member nominations, eight peer references, a minimum
practice of five years, and a minimum of 200 civil mediations.
Attorney Ron Darrigo possesses a deep understanding of the anatomy of disputes
and conflicts, enabling him to disassemble a controversy and reframe individual
issues to create a better understanding among the parties involved. With
his mediator certification and litigation experience, Mr. Darrigo is uniquely
positioned to help clients resolve complex legal conflicts in the Tampa Bay area.
Understanding the Mediation Process
Regardless of the unique issues involved in a case, the goal of mediation
is always to amicably resolve a legal dispute outside of the courtroom
by reaching an acceptable agreement on behalf of the parties involved.
The process is facilitated by a mediator, a neutral third-party that sifts
through the facts and individual interests of the case to promote dialogue
and resolution. The mediator does not possess the authority to impart
a settlement; rather, they operate as a go-between, employing negotiation
strategies to reframe individual issues to create better understanding
among the parties involved.
The mediation process involves a series of joint councils and private sessions,
and it is often the task of the mediator to determine when each type of
meeting will be conducted. Typically, the mediation will begin with a
joint session that includes all of the parties involved in the dispute.
Then, the opposing parties will separate into private rooms to initiate
the negotiation process. It is important to know that parties are not
compelled to reach an agreement. Impasse is declared if either party or
the mediator deems continued negotiations to be futile. Yet, mediation
is often an effective, non-adversarial alternative to dispute settlement,
allowing the involved parties to save time and money.
